Welcome to the KVM App! These Terms and Conditions ("Terms") govern your access to and use of the Kiran Vidhya Mandir Sr. Sec. School ("KVM", "the School", "we," "us," or "our") App and related services. By accessing or using the App, you agree to be bound by these Terms.
By creating an account, accessing, or using the KVM App (including the Student Portal, Parent Portal, Faculty/Staff features, Exam Module, Fees Module, Hostel Management, Library Management, Transport Management, and Chat/Notifications), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the App.
You must be a currently enrolled student, parent/guardian of an enrolled student, or a member of KVM's faculty/staff to use the App. Students under the age of 18 may use the App only with the consent and supervision of their parent or legal guardian.
Accounts are typically created by the School's administrators. You are responsible for:
You agree to provide accurate, current, and complete information and to update it as needed to maintain its accuracy.
Your access to the App is granted by the School for as long as you remain a student, parent/guardian of an enrolled student, or staff member of KVM. We reserve the right to modify, suspend, or terminate your access at any time, with or without notice, for violations of these Terms, upon a student's withdrawal/graduation, or upon a staff member's exit.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
a) Use the App in any way that violates applicable local, state, national, or international law or regulation.
b) Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App, or which may harm the School or other users.
c) Impersonate or attempt to impersonate another user, person, or entity.
d) Use the chat, notification, or any communication feature for harassment, bullying, spamming, or transmitting offensive, obscene, or inappropriate content.
e) Upload or transmit viruses, malware, or any other malicious code that may damage or interfere with the App's operation.
f) Attempt to gain unauthorized access to any portion of the App, other users' accounts, or any connected systems or networks.
g) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.
h) Use any automated system (bots, spiders, scrapers) to access the App without prior written permission.
i) Collect or harvest personally identifiable information from the App without proper authorization.
j) Use the App for any commercial purpose not authorized by the School.
The App and its entire contents, features, and functionality (including software, code, text, displays, graphics, design, and arrangement) are owned by Kiran Vidhya Mandir Sr. Sec. School and/or its technology service provider, [Name of App/ERP Provider, if applicable], and are protected by copyright, trademark, and other intellectual property laws.
You retain all rights to the Content you submit, upload, or create on the App. By submitting Content, you grant the School a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such Content solely for the purpose of providing and improving academic and administrative services.
"Kiran Vidhya Mandir," the KVM name, logo, and related marks are trademarks/identifiers of the School. You may not use such marks without prior written permission.
Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you acknowledge and agree to the collection and use of information as described in our Privacy Policy.
The Fees Module allows the School to collect tuition and other fees from students/parents. Any fees paid through the App are subject to the School's fee policies, schedules, and payment terms.
We may use third-party payment processors/gateways to facilitate fee transactions. You agree to comply with the terms and conditions of such payment processors. KVM is not responsible for delays, errors, or issues caused by third-party payment processors.
Fee refunds, waivers, or disputes are governed by the School's fee policy, available separately from the School administration.
The App may contain links to or integrate with third-party services (e.g., payment gateways, SMS/email providers) that are not owned or controlled by KVM. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.
You agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party content, goods, or services.
We strive to provide continuous access to the App but do not guarantee that it will be available at all times or will be uninterrupted, timely, secure, or error-free.
We reserve the right to modify, suspend, or discontinue any part of the App (temporarily or permanently) with or without notice for maintenance, updates, or improvements.
We may revise these Terms from time to time at our sole discretion. Changes are effective immediately when posted. Continued use of the App after changes means you accept the revised Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for reasons including:
Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination (ownership, warranty disclaimers, indemnity, limitations of liability) shall survive.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, KVM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KVM, ITS MANAGEMENT, STAFF, OR TECHNOLOGY SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, GOODWILL, OR ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS, THIRD-PARTY CONDUCT, OR CONTENT OBTAINED FROM THE APP.
You agree to defend, indemnify, and hold harmless Kiran Vidhya Mandir Sr. Sec. School, its management, staff, and technology service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
These Terms shall be governed by and construed in accordance with the laws of India.

If any provision of these Terms is held invalid or unenforceable, that provision shall be struck and the remaining provisions shall remain in full force and effect.
No waiver of any term shall be deemed a further or continuing waiver of such term, and our failure to assert any right shall not constitute a waiver of that right.
